But still, Jiraiya could utilize Jutsu, whereas Orochimaru could not. Orochimaru fought and defeated the strongest Konoha shinobi, Sandaime Hokage, and still got up and fought two Sannin equaly with the help of a ninja weaker than Kakashi. I believe he was in the worst shape. Even still, he caused Tsunade to shorten her life with Kabuto, and even after, he still was alive. I also believe Manda > Gamabunta and Katsuyu had it not been for Tsunade.

So, all in all, Orochimaru still beat him; he was in worse condition.

Nah, Orochimaru is just one of those people who don't die. He reshaped himself after getting his face ripped off (KN1) arm ripped off (KN3) and basically slashed and sliced in half (KN4) and even punched and used as a ragdoll (Tsunade) and don't forget the fact that his arms were rehealed somehow.

Even Sasuke, he didn't kill Orochimaru, and Orochimaru while sick could've killed him if he wanted.

Even in his true form, he was durable enough to be cut in half and survive. It's Orochimaru himself who is extremely durable.

When was he cut in half? Also he shows himself in his true form but it isn't the same body. He changes the new body to his true form because that is what everyone knows. He can change back to the BODY's true form at will (See the invasion of Konoha) He has spent so much time altering his body it isn't even funny.

I'm saying that reason Orochimaru's bodies are so durable is that his true form is beastly. Now, look at this...

Only due to the fact Orochimaru could only use his tongue and mouth to fight.
He couldn't protect himself like he could have. If he did have useable arms, I don't think Tsunade would have been alive after she tried to protect Naruto.

Orochimaru is the stronger one. Most likely because he's been training himself. Jiraiya was busy with Icha Icha, Tsunade was busy gambling. But, during that whole time lapse of the three being seperated, Orochimaru continued to train and make himself stronger. The only desire he has is to become the most powerful ninja by learning all jutsu and living forever. I doubt he took a break with such things.

I would say it would be a close battle, very close. Jiraiya tried to stop Orochimaru from leaving as did Naruto to Sasuke. Did he stop him? Nope, he couldn't. What does that tell you? Since this is Manga I feel comfortable saying this but I am still going to add a spoiler tag.

If Pein doesn't kill Jiraiya and Orochimaru completely/majority takes over Kabuto then we may see them go at it again hopefully at a 100%. Last time Orochimaru had no arms that were useful and Jiraiya was drugged. They both have kick ass techniques though.

He did not win, merely survived. Well let me change that. Him winning is HIGHLY debatable. He took down two dead Hokages and took Orochimaru's arms. The ONLY reason he didn't dodge the sword through his chest was because he thought he was strong enough to pull his soul out. However the sword through the chest probably didn't help any. Why Enma didn't just pull the sword out is beyond me, stupid monkey.
